My drivers license will be suspended for unpaid child support (Oregon). I'm unemployed and need a plan by ericpidin legaladvice

[–]parsnippity 1 point2 points ago

Yeah, you don't owe HER child support, you owe it to the state at this point, to reimburse for the health insurance. In order to get the insurance, she had to agree to cooperate with them. She can't waive child support.

OP, visit the Oregon child support calculator, and see what you should be paying according to Oregon Law: https://justice.oregon.gov/guidelines/ .

Advice regarding Age of Consent by NotAGoodManAtAllin legal

This is a LEGAL ADVICE subreddit... not "oh, is it morally ok to do X". The reality of the situation is that it is not LEGALLY ok to do.

That's ma'am. And the guy lied to and manipulated a 16 year old girl for sex, and THEN, today, he posted that he plans to continue doing so to keep her from telling his wife? Fuck yes I did, and I'm proud of it.

This is horrible advice. Never talk to the police without an attorney present, period. Never admit ANYTHING to the police without an attorney present, period.

Yes, it does. Each act is a separate crime. 10 charges, versus 100.

And I did report it, to the FBI, because you committed a federal felony. I included links, screenshots and all. And you can't delete it, because that's not how reddit works.

Have fun, shithead.

Which states? It matters a LOT.

It absolutely gets enforced. In some states, it's just straight sexual assault, and in others, it's statutory rape. Just as an example, take a look at North Carolina's sex offender registry. Just search any area. I'd wager that about 60-70% of the "indecent liberties with a minor" convictions on there are people who pleaded down from statutory rape.

Punishment varies by jurisdiction, and on what you're actually convicted of. Registration as a sex offender is virtually guaranteed. Anything beyond that requires knowing where you're located... as does telling you if you've actually committed a crime.

ETA: In your other thread, you state that you transported her across state lines to have sex with her. That's a federal felony, punishable by a MINIMUM of 5 years in prison.

Question about legitimizing of my child by threenomsin legaladvice

[–]parsnippity 0 points1 point ago

If the mother is willing to waive her right to child support in court, sure.

You need to let the court order child support though. If you don't, any and all money you give her is not child support, and the court WILL consider it a gift, regardless of the evidence you provide to the contrary. Should things ever sour between you, she can say you've never paid a dime, and you'll look like crap to the court.

Question about legitimizing of my child by threenomsin legaladvice

[–]parsnippity 0 points1 point ago

If you filled out the acknowledgement of paternity in the hospital when the baby was born and have that form notarized (the notary is usually in the hospital and does it right there, so if you showed your ID while you were doing the form, you probably had it notarized, you're good to go. If you didn't, then your paternity isn't legitimated.

That form in GA has two sections... the top section, the acknowledgement of paternity, is all that needs to be done to be on the birth certificate. You have to legitimate your paternity as well... that's on the second section of the form. And the mother of your child is right... you have to do that to have those rights. So go to court!

You haven't said where you are, but if you're pretty much anywhere in the US, and you don't have a contract specifying otherwise, then yes. Your manager is absolutely allowed to do that.

A question about divorce and dissolution of a new marriage after the fact by sillyokioin legaladvice

[–]parsnippity 0 points1 point ago

I'd say that the court re-instated the marriage, meaning the divorce wasn't valid... they were married the entire time, so she's now entitled to part of what he earned while they were "divorced" too.

Where is this happening? What state?

Yeah, they have. Mexico has residency requirements now. Guam and the Dominican Republic are the easiest these days, though Guam requires that you be there for 7 days.

International Divorce. Is it really an option to dissolve a marriage within days? by SpecialOpsCynicin legaladvice

[–]parsnippity 0 points1 point ago

Yes, you can really go to the Dominican Republic and obtain a divorce in just a few days. The question you should be asking, though, is whether your state will recognize it.

First and foremost, your nation of residence isn't soaking you for anything. Marriage and divorce is almost entirely a state issue... and not all states have year long waiting periods. Heck, Nevada does it in a week. It is your state you are paying fees to. Not your country.

As to the question of whether it will be recognized in Maryland, the answer is yes, IF both parties participate in the divorce. This means that you must both go to the Dominican Republic and appear together at the hearing. The option to have one person go and the other sign paperwork in the US doesn't work for Maryland.

It is VITAL that you meet with a local attorney before you do this. Any child custody issues, property settlement issues, etc. need to be worked out and agreed upon BEFORE you go.

Lost Poms, stranger found, refuse to return one of them by abvinhin legal

[–]parsnippity 0 points1 point ago

Oklahoma has specific statutes regarding lost property, so general overviews of various laws aren't going to be relevant.

If she deleted the contact info, she probably has a cell phone. Looking at her call log on her bill, either online or by calling the company will get her the number.

You need to sue her. She probably didn't give the dog to anyone, and just doesn't want to give it back. Fees are around $50 in Oklahoma, so it's not going to break the bank. Bring everything you have to court to prove that they have or had the dog.

This isn't Judge Mathis... people suing for harassment have to have actual damages. Are you calling them at work? Are you being threatening? If not, don't worry about it.

Lost Poms, stranger found, refuse to return one of them by abvinhin legal

[–]parsnippity 0 points1 point ago

It's all a big maybe. Oklahoma is one of a handful of states that have lost property statutes.

"One who finds a thing lost is not bound to take charge of it; but if he does so, he is thenceforward a bailee for the owner, with the rights and obligations of a bailee for hire."

This basically means that someone who finds something someone else lost can, but doesn't have to take charge of it. If they do, they take responsibility for it, to a certain degree.

If the finder of a thing knows or suspects who the owner is, he must, with reasonable diligence, give him notice of the finding; and if he fails to do so, he is liable in damages to the owner, and has no claim to any reward offered by him for the recovery of the thing, or to any compensation for his trouble or expenses.

This means that there is an obligation for the person who found your dogs to notify you that they have them IF they know or suspect who you are. They suspected when they were told by your neighbor. They knew when you contacted them.

The finder of a thing may exonerate himself from liability at any time, by placing it on storage with any responsible person of good character, at a reasonable expense.

And here's where there's trouble for you. They gave the dog to someone they trust, so they have exonerated themselves from liability. If they did that BEFORE they knew who you were, then they're probably in the clear.

So basically, if the mother gave them to her daughter before finding out that you're the owner, she's absolved of all responsibility. The daughter now knows who you are, BUT she isn't the "finder", so whether you'd win or lose in court is a big "maybe". You have a fair chance. I suspect that if you sue, you'll get the dog back.

[–]parsnippity 0 points1 point ago

So, which is it? Did you not have the tags on because they had just gotten bathed or did you lose the tags and not bother to replace them immediately? Because you told two different stories about the tags here.

The people who found your dogs didn't do anything wrong INITIALLY in this case. The only duty they had was to contact you IF there were tags. Because there were no tags and they couldn't contact you, that was that. That said, if they still have your dog, or if they refuse to tell you who the dog, they COULD, possibly, MAYBE be responsible in small claims court for the value of the dog, especially if they still have it. If it's got AKC papers, that's going to probably be what you paid for the dog.

I suspect that if you sue them, you'll quickly get the information you need from them. If the person they gave the dog to won't give it back, you can sue them for the cost of the dog.

You need to understand that unless YOU provide someone with a way to contact you, they do not have an obligation to go out of their way to post online or in the newspaper or anything like that.

All told, I suspect that they still have your dog and just don't want to give it back. So you're going to have to sue them.
